Loan Modifications and Loan Workouts
Many
homeowners consider bankruptcy only because there are very
few options available to fix their current home mortgage
problems. Often homeowners have sufficient income to pay
most of the monthly payment. However, once behind, lenders
accelerate the loan and only accept full payments. The
current lending system was designed for an economy when
monthly mortgage payments never exceeded 35% of homeowners
monthly income.
Lenders will seldom offer to renegotiate existing loans,
restructure payments or reduce the loans interest rate
unless they are persuaded to
take action. Most of the present day modifications and
workouts involve a second bridge loan, deferred principal
payments, and short sales. Attorney Grew assists homeowners
renegotiate their existing home loan in order to reduce the
interest rate and lower the monthly payment. Our office
will arrange for a full forensic loan analysis to be
performed on your existing home loan. The analysis will
identify and rate any improper and illegal practices found
in your loan. The fact is, many recently issues home loans
do not conform with federal and state lending laws and
regulations. With a list of "issues" in hand Attorney Grew
can then approach your lender to propose a modification that
is your best interest. Making your lender or current
holder aware of the potentially illegal parts of your loan
may put you in a much better position to modify /
renegotiate your existing home loan. Once a lender or
holder is made aware that the loan violates federal and
state standards, the lender and holder recognize the
importance of making the loan right.
Lenders will work with the creditor / home owner to keep
the home out of foreclosure either through a loan
modification, a workout or even allowing a short sale to
remove the debt from your hands. Bankruptcy is a powerful
and useful method of managing a current loan arrearage;
however, you should examine all the possible options before
choosing the best solutions.
It is important to know your legal rights prior to
entering into a discussion with your lender about modifying
your original loan agreement, entering into a second loan
agreement or restructuring your payment schedule. Knowing
your rights puts you in a better position to negotiate a
solution. Attorney Grew can arrange for a full and
comprehensive forensic analysis of your current home loan to
ensure that it complies with federal and state regulations.
