Foreclosure and Bankruptcy

For many individuals, their first contact with a bankruptcy attorney is related to a foreclosure on their home or other property.

Foreclosure is a legal process in which a lender, who holds a mortgage on your property, seeks to execute the mortgage and take possession of your home because you were not able to make timely payments on your loan.

When your property is under foreclose the lender or mortgage holder may sell your property to pay for the outstanding loan as well as any legal and foreclosure fees.

The law governing foreclosure can be complex, however, the final outcome is simple, your property is taken and sold to a third party.

Typically, you have no recourse against the lender or purchaser after the sale. However, there are several options available prior to the foreclosure.

Many lenders will work with the creditor / home owner to keep the home out of foreclosure.

You should learn your legal rights prior to entering into a discussion with your lender about modifying your original loan agreement, entering into a second loan agreement or restructuring your payment schedule.

Knowing your rights puts you in a better position to negotiate a solution.

If your lender has notified you that your loan is in default, or they are "accelerating" your loan, or the lender has placed your home in foreclosure you need to speak to an experienced and skillful attorney about your rights as a debtor.
