Chapter 7 Bankruptcy

A Chapter 7 discharge removes your obligation, as the debtor, to repay any unsecured debts i.e. credit card debt, medical bills, personal unsecured loans, judgment against you, account balances for services, past due utility bills and even some tax debts.

Once you file a Chapter 7 Petition the Bankruptcy Court will appoint a Chapter 7 Bankruptcy Trustee to handle your case. The Trustee's, job is to review your case to ensure that your petition conforms with the Bankruptcy Code. In the event that there is a problem, the Trustee will contact your attorney and the Petition can be amended. The fact is, most petitions go though the Bankruptcy Court without any problem. can continue to pay the monthly loan payments (if applicip. Any person or married couple can file bankruptcy, including non-U.S. citizens so long as they have not received a discharge under the bankruptcy court in the past 6 years. You can file a singe bankruptcy petition, or if you are married at the time of filing, you can file jointly with your spouse.

You file in the state which reside. Bankruptcy law which most of us are familiar with is federal law Title 11 of the United States Code. (11 U.S.C. 101-1330). You can file bankruptcy without an attorney, however, it is in your best interest most of the time, to hire an attorney to represent you. The benefit of receiving a full discharge greatly outweigh the savings of trying to file the petition yourself. The federal court system is not as easily navigated as the state courts. Additionally, there are specific state rules for each state.
