Bankruptcy law offers several types of relief for debtors unable to manage their debt. Some clients may benefit from the protections offered in a Chapter 7 bankruptcy that discharges most or all of your unsecured debt such as credit card balances, medical and professional bills, judgments and past due accounts.

In many cases where individuals and families are behind on their home or other secured loan and facing default, foreclosure or repossession, a Chapter 13 "repayment plan" provides the necessary relief to keep your home while getting the benefits of a "fresh start" with unsecured creditors.

A chapter 13 is a debt repayment plan for individuals whose debt level meets the legal requirements. Chapter 13 usually allows individuals and families to keep their property by repaying their creditors with future earnings. Upon filing a Chapter 13 bankruptcy, you would submit a repayment plan. Generally, unsecured creditors will receive a small percentage of what is owed to them while your secured creditors will be paid in full over a period of up to 60 months. For example, if you are 4 months behind on your mortgage and facing foreclosure and you are past due on your automobile loan, a Chapter 13 plan would first stop any pending foreclosure on your home or repossession of your vehicle. Then, you would pay the past due amounts, administrative costs of the plan and a small percentage of our unsecured debts over time.

Although a Chapter 13 plan may sound difficult, it is relatively simple and allows individuals and families earning regular income to safely transition form debt to financial security.
